2. Scope, definitions and governing law
These Terms and Conditions (T&Cs) govern the use of the cellashop.hu online store, the ordering, payment and delivery of goods sold by the Provider, and the related rights and obligations. By placing an order, the Customer accepts the T&Cs available at the time of the order and the product safety notice.
- Consumer: a natural person acting outside their trade, business, craft or profession
- Business customer: a person acting within their trade, business, craft or profession
- Customer: consumer and business customer collectively
- Goods / Product: lithium-ion cells sold in the Webshop and any products later added
These T&Cs do not restrict mandatory consumer rights that cannot be derogated from by agreement. Matters not regulated here are governed in particular by the Hungarian Civil Code, the Act on electronic commerce, and the decrees on consumer contracts.
3. Availability and amendment of the T&Cs
The T&Cs can be continuously downloaded and saved from the Webshop. The Provider archives the current and previous versions with dates. The version in force when the order is placed applies to that order.
The Provider may amend the T&Cs for the future, in particular due to changes in law, processes or features. An amendment must not retrospectively worsen the terms of contracts already concluded. The effective date must be stated at the beginning of the new version.
4. Webshop products and product safety
The Webshop currently offers unprotected Samsung ICR18650-26J lithium-ion cells. The product is not a finished consumer battery pack, has no built-in protection, and improper handling may involve fire, explosion, burn and toxic-gas risks.
- Before purchase, the Customer must read the product page, the manufacturer datasheet and the Battery Safety Notice.
- Unprotected cells may only be used within the official datasheet limits, with a suitable BMS or protection circuit, and with a compatible certified charger.
- Short circuit, overcharge, deep discharge, overcurrent, overheating, mechanical damage, throwing into fire, immersion in water and reverse polarity connection are prohibited.
- Building cells into a battery pack may only be done by a person with appropriate expertise, matching of compatible cells and safe welding technology.
- Damaged, swollen, leaking, rusty, dented, heating or cells of unknown history must not be used, charged or shipped as ordinary parcels.
- Keep the product away from children; only persons aged 18 or over with full legal capacity, or duly represented organisations, may place orders in the Webshop.
Damage arising after performance due to breach of safety rules does not constitute defective performance. This provision does not exclude or limit liability that cannot be excluded by law for defective products, product liability, death or personal injury.
5. Technical steps of ordering
- The Customer selects the product and available quantity, then adds it to the cart.
- In the cart the Customer checks the product, quantity, unit price, discount and subtotal; incorrect data may be corrected or deleted until the order is submitted.
- The Customer provides billing, shipping and contact details and selects an available shipping and payment method.
- On the order summary page the Customer checks the total payable amount, including shipping and cash-on-delivery fees, accepts the T&Cs and acknowledges the privacy notice.
- The Customer submits the order with a button that clearly indicates a payment obligation — for example “Order with obligation to pay”.
- The Webshop sends an electronic acknowledgment of receipt; the Provider then accepts or, where justified, rejects the order by a separate statement.
Before submitting the order, the Customer may correct input errors by editing fields and the cart. Errors noticed after submission must be reported immediately to info@cellashop.hu; the Provider will reasonably assist with correction depending on the stage of performance.
6. Offer, confirmation and formation of the contract
Submitting the order is a binding offer by the Customer. The automatic technical acknowledgment of receipt only confirms that the offer reached the Provider’s system; it does not by itself mean acceptance of the offer.
The contract is formed when the Provider sends an email expressly accepting the order or confirming handover for fulfilment, containing the essential order details. If the automatic acknowledgment does not arrive within 48 hours of submission, the Customer’s offer binding ceases.
In case of stock shortage, obvious price error, shipment that cannot be performed safely, failed payment or a legal obstacle, the Provider may reject the offer with reasons. Any amount already paid will be refunded without undue delay.

7. Prices, discounts and stock
Prices shown in the Webshop are final product prices payable by the consumer in Hungarian forints; tax content is shown on the invoice. Shipping, cash-on-delivery or other ancillary fees appear separately before finalising the order and as part of the total amount.
The product page may include quantity discounts, order minimums or maximums, stock information and temporary free-shipping conditions. The clearly accepted conditions displayed on the summary page apply. Discount rules and — where a price reduction is announced — the prior price required by law must be shown transparently.
In case of an obviously erroneous price that differs conspicuously from the product’s usual value or related information, the Provider informs the Customer of the correct price; the Customer may accept it by a new statement or withdraw the order free of charge. The Provider may not invoke a price error merely because the transaction later proves unfavourable to it.
8. Payment methods
Available options are those actually shown at checkout:
- Card (Visa, Mastercard): payment is handled by [KITÖLTENDŐ: elfogadó és fizetési szolgáltató]. The Provider does not store full card data.
- PayPal: payment takes place on PayPal’s own interface under its own terms.
- Cash on delivery: payment on receipt by the courier or locker method supported; any COD fee appears at checkout.
- Barion: becomes available only when actually activated at checkout, and the provider’s details appear in the T&Cs and the privacy notice.
The payment service provider’s own fraud-prevention, authentication and data-processing rules apply. If payment fails or is declined, the order is not considered paid.
9. Shipping and performance
The Provider currently ships only to addresses in Hungary. According to the information on the website, GLS home delivery and Foxpost parcel lockers are available; the actual fee and expected time are shown at checkout.
- GLS home delivery: indicative 1–3 business days; fee indicated at the time of publishing this version: HUF 1,990.
- Foxpost parcel locker: indicative 1–2 business days; fee indicated at the time of publishing this version: HUF 990.
- At the time of publishing this version, the website indicated free GLS or Foxpost shipping for orders of 75 or more cells. Check the current discount conditions at checkout.
Deadlines are estimates; the dangerous-goods classification of lithium-ion cells, carrier approval, weather, public holidays, stock or force majeure may cause delay. If the delay is material, the Provider informs the Customer and provides an additional deadline or a right to terminate as required by law.
In consumer contracts, risk of loss passes to the consumer when they, or a third party other than the carrier designated by them, take possession of the goods. If the consumer commissions their own carrier not offered by the Provider, risk passes upon handover to that carrier.
On receipt, the Customer should check the outer packaging where possible. In case of damage, request a report and take photos; their absence alone does not exclude a claim based on law.
10. Withdrawal and returns
The consumer has a 14-day right of withdrawal without giving reasons from receipt of the product. Withdrawal may be exercised via the online “Withdraw from the contract” function, by email, by post or using the model form. Detailed rules are set out in the separately published Returns and Withdrawal Policy, which forms an inseparable part of these T&Cs.
Safe return of lithium-ion cells must be arranged in advance. Safety coordination does not make withdrawal subject to prior permission. Opening the packaging of cells sold from ordinary stock does not by itself exclude withdrawal.
11. Warranty for defects (kellékszavatosság)
The Provider performs defectively if the goods do not meet the requirements of the contract or of law at the time of performance. In consumer contracts, the warranty claim for defects generally becomes time-barred two years after performance. A defect discovered within one year of performance is presumed to have existed at performance, unless that presumption is incompatible with the nature of the goods or the defect.
Depending on the nature of the defect and the circumstances, the consumer may:
- request repair or replacement, unless the chosen remedy is impossible or would cause disproportionate additional cost;
- claim a proportionate price reduction or terminate the contract if the Provider fails to bring the goods into conformity, the defect reappears, the seriousness of the defect justifies immediate price reduction or termination, or it is clear that the Provider will not perform within a reasonable time without significant inconvenience;
- termination is not available for a minor defect; proving that the defect is minor is for the Provider.
Repair or replacement is free of charge, within a reasonable time and without significant inconvenience to the consumer. The consumer must notify the defect without delay after discovery; notification within two months is deemed without delay.
12. Product warranty (termékszavatosság)
In case of a defect in movable goods, the consumer may — instead of a warranty claim for defects, at their choice — request repair or replacement directly from the manufacturer or distributor. The product warranty claim may be enforced for two years from the manufacturer’s placing of the product on the market. The consumer must prove the product’s defect and that it existed when placed on the market. The manufacturer may be exempted on grounds set out in law.
13. Mandatory and voluntary guarantee (jótállás)
Mandatory guarantee applies only to new durable consumer goods listed in the ministerial decree in force and whose sale price reaches the statutory threshold. At the time of publishing this version, for listed products priced from HUF 10,000 up to and including HUF 250,000 the mandatory guarantee is two years; above HUF 250,000 it is three years. A standalone battery cell is not automatically treated as a product subject to mandatory guarantee; the classification of the specific product must be examined.
If the product page or a separate guarantee statement promises a voluntary guarantee beyond the law, its terms bind the guarantor and do not reduce the consumer’s statutory rights.
14. Reporting warranty and guarantee claims
Claims may be reported at info@cellashop.hu, by post or at [KITÖLTENDŐ: személyes ügyintézési helyen]. The report must include the Customer’s name, contact details, order identifier, product identification, description of the defect and the remedy sought. The Provider draws up a report, provides or sends a copy, and retains the report for three years.
Purchase may be proven by online order data, invoice, receipt or other credible means; original packaging may not be made a condition of a statutory claim. The Customer must not ship dangerous or damaged cells without prior safety coordination.

The Provider examines oral complaints immediately and remedies them where necessary. If that is not possible, or the consumer disagrees, a report is drawn up. Written complaints are answered in writing, on the merits and in a verifiable manner within 30 days of receipt. On rejection, the Provider gives reasons and informs about administrative, conciliation-board and court remedies.
The Provider retains the complaint and a copy of the reply for three years.
16. Customer reviews
If the Webshop displays consumer reviews or an aggregated rating score, it clearly explains next to the reviews whether authenticity checks are performed and, if so, how. Recommended process to implement before publication:
- review invitations may be sent only via unique links tied to completed orders;
- a review successfully linked to an order receives a “Verified purchase” mark;
- unverified reviews must not receive that mark, and the page must not suggest that every review is from a real buyer;
- moderation may occur only for pre-published, content-neutral reasons, e.g. unlawful, hateful, personal-data, advertising or non-product content; a merely negative opinion must not be deleted;
- the calculation method of the aggregated score and the review period must be explained; incentivised reviews must be labelled.
17. Conciliation board and consumer authority
Before conciliation-board proceedings, the consumer must attempt to settle the dispute directly with the Provider. The procedure is free of charge; the Provider has a duty to cooperate.

The consumer may turn to the board competent for their place of residence or stay, or within the limits of the law to a board of their choice. For administrative consumer-protection matters, the competent government office acts; contact details are available on kormanyhivatalok.hu.
The European Commission’s former Online Dispute Resolution (ODR) platform was discontinued in 2025; these T&Cs therefore contain no outdated ODR link.
18. Personal data
Details of personal-data processing are set out in the separately published Privacy and Cookie Notice. Acknowledging the notice is not consent to processing necessary for contract performance or required by law.
19. Intellectual property
The Webshop’s structure, text, graphics, own photographs, database and marks may be protected by copyright or other rights. Copying, distribution, automated data extraction or commercial use beyond personal use without the rightholder’s prior permission is prohibited, except where permitted by law. Manufacturer brands and data remain the property of their rightholders.
20. Liability and force majeure
The Provider is liable under the law for its own breach of contract, defective performance and the safety of the products distributed. It is not liable for damage proven to have been caused after handover by use contrary to the manufacturer datasheet and safety instructions, unprofessional installation or unauthorised modification, provided the damage is not attributable to a defect existing at handover or to incomplete information.
Liability cannot be excluded for death, personal injury, intentional damage, product liability or other cases that cannot be excluded by law. In case of unavoidable external cause, the parties cooperate to reasonably reduce delay and damage; mandatory consumer rights remain.
21. Final provisions
Hungarian law governs the contract. This choice of law does not deprive the consumer of protection that cannot be derogated from by agreement and that would otherwise apply under the law of their place of residence. The consumer may bring proceedings before the court competent under the law; a separate jurisdiction clause with a business customer may only be applied in a fair, individually accepted and lawful form.
If any provision of these T&Cs is invalid or unenforceable, that does not affect the validity of the remaining provisions; mandatory law applies instead of the invalid provision.
