Returns and Withdrawal Policy

Lithium-ion cells may only be returned under the safety procedure below. Dangerous goods must not be shipped to the return address without prior arrangement or without proper packaging.

2. Who may withdraw without reason?

The 14-day right of withdrawal without reason is available to consumers under the Hungarian Civil Code — natural persons acting outside their trade, business, or profession. For business or professional purchases this right exists only if the Provider has expressly agreed to it in writing. Rights arising from defective performance remain independent of this.

3. Withdrawal period

• The consumer may withdraw without reason within 14 days of receiving the goods.
• If several goods from one order are delivered at different times, the period starts from receipt of the last good.
• For goods consisting of multiple lots or pieces, the period starts from receipt of the last lot or piece.
• The consumer may also exercise withdrawal between conclusion of the contract and receipt of the goods.
• The deadline is met if the consumer sends the withdrawal notice before the 14-day period expires.

4. How to communicate withdrawal

The consumer may give notice of withdrawal by any of the following:

• the continuously available “Withdraw from contract” online function on cellashop.hu;
• sending the model withdrawal form at the end of this policy;
• any other unequivocal statement by email or post expressing the intent to withdraw.

The burden of proving withdrawal lies with the consumer; keep the sent email, postal receipt, or online acknowledgment.

5. Online withdrawal function

The online function must make it easy for the consumer to communicate:

• the decision to withdraw from the contract;
• their name;
• details identifying the contract or order;
• the electronic address to which confirmation of withdrawal should be sent.

The declaration must be submitted with the “Confirm withdrawal” action. Without undue delay the Provider sends an acknowledgment of receipt on a durable medium — typically email — containing the content of the withdrawal and the date and time of submission.

6. Return deadline and cost

The consumer must return or hand over the goods without undue delay and no later than 14 days after communicating withdrawal. The deadline is met if the goods are dispatched before the 14th day by a method approved by the Provider.

The consumer bears the direct cost of return due to withdrawal, unless the Provider agrees to bear it or failed to inform the consumer of this cost in advance. Because standalone lithium-ion cells may fall under dangerous goods rules, ordinary postal return may not be possible. Approved return carrier and method: GLS. Estimated direct cost borne by the consumer, or a reasonable upper estimate: HUF 3,000 per parcel.

7. Safe return of lithium-ion cells

Before returning, the consumer must contact the Provider by email and follow packaging and shipping instructions for that shipment. This safety coordination does not make withdrawal subject to permission and does not shorten the notice period.

• Insulate each cell’s terminals with non-conductive material; pack cells separately, secured against movement and short circuit.
• Do not ship cells as ordinary letter mail, in unpadded envelopes, or loose bulk packaging.
• Do not ship damaged, punctured, leaking, swollen, unusually hot, burnt-smelling, or short-circuited cells by post or locker. Contact the Provider immediately for safe collection or disposal instructions.
• If a cell is smoking, hissing, or generating heat, personal safety comes first: move away, call emergency services, and do not prepare the cell for transport.
• Always comply with the carrier’s dangerous goods packaging, labelling, quantity, and handover rules.

If the defect, damage, or incorrect fulfilment falls within the Provider’s sphere of interest, the Provider covers or reimburses the justified cost of lawful and safe return.

8. Condition of goods and diminished value

The consumer may examine the goods to the extent reasonably possible in a shop. The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

For unprotected cells, diminished value may especially result from welding, soldering, attaching tabs, removing shrink wrap or factory markings, building into a pack, multi-cycle charge or discharge, overloading, or polarity/short-circuit damage. Such use does not automatically extinguish the right of withdrawal, but proven diminished value may be deducted. Lack of original packaging alone does not exclude withdrawal; packaging suitable for safe transport is mandatory.

9. Refund

• Within 14 days of learning of the withdrawal, the Provider refunds the price paid and the cost of the least expensive standard delivery method.
• Extra cost of a delivery method chosen by the consumer that is more expensive than the least expensive standard method is not refunded.
• On partial withdrawal, delivery costs are refunded only to the extent the consumer would not have incurred the same charge for the remaining goods.
• Refunds use the same means of payment as the original, unless the consumer expressly agrees otherwise; no fee may be charged for this.
• The Provider may withhold the refund until the goods are received back or the consumer provides clear evidence of proper return, whichever is earlier.

10. Exceptions to the right of withdrawal

Withdrawal may be excluded only in cases set out in Government Decree 45/2014 (II. 26.). Opening the packaging of Cellashop’s ordinary stock-sold cells is not in itself a hygiene exception.

If the Webshop makes a custom battery pack, individually welded, sized, or personalised product at the consumer’s instruction or express request, withdrawal may be excluded for that item, provided it is truly not prefabricated and the consumer was clearly informed before ordering. Ordinary quantity stock packs or volume discounts do not thereby become custom products.

11. Defective, damaged, or wrong product

Withdrawal without reason is not the same as a warranty claim for defective performance. If the product is defective, damaged in transit, or not what was ordered, notify info@cellashop.hu without delay, preferably with photos and the order ID. Lack of a photo or carrier protocol alone does not extinguish a statutory claim.

For a justified defect or incorrect fulfilment, the Provider bears the justified return cost, and the warranty rules of the Terms apply.

12. Uncollected parcels

Failure to collect or refusal of a parcel is not in itself an unequivocal withdrawal notice. The consumer should therefore communicate withdrawal separately. The Provider may only claim lawfully enforceable, proven, and reasonable extra costs; no punitive fee may be charged for exercising the consumer right of withdrawal.

13. Model withdrawal form

Use. Complete and return this model only if you intend to withdraw. The online withdrawal function, email, or any other unequivocal statement may equally be used.
